1. Introduction and Acceptance

Welcome to PhysioWay. These Terms and Conditions ("Terms") govern your use of our home physiotherapy management platform, including our website at www.physioways.com and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Service Description

PhysioWay is a home physiotherapy management platform founded by Dr. Rajavi Dixit, serving Ahmedabad and Gujarat, India. Our platform enables:

  • Patients to register, book physiotherapy appointments, track treatment progress, and view session history
  • Therapists to manage schedules, submit session reports, track attendance, and conduct home-based treatments
  • Doctors to oversee treatment plans, add patients, review therapist reports, and monitor patient outcomes
  • Administrators to manage operations, approve accounts, monitor safety, and ensure quality of care

Our Service is a management platform and does not itself provide medical advice, diagnosis, or treatment. All physiotherapy services are provided by licensed healthcare professionals.

3. User Accounts

3.1 Registration: You must create an account to use our Service. You agree to provide accurate, current, and complete information during registration. All users must select a role (Patient, Therapist, or Doctor) during registration.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.

3.3 Role-Based Access: Different user roles have different access levels and responsibilities. You agree to use your account only for its intended purpose. Unauthorized role escalation or access attempts are strictly prohibited.

3.4 Account Approval: Therapist and Doctor accounts require verification and admin approval before full access is granted. Therapists must provide valid identification (Aadhaar number), professional license details, certification documents, and profile photographs as part of the approval process.

3.5 Account Deletion: You may request account deletion at any time. Due to medical record retention requirements under Indian law, your data will be soft-deleted (deactivated) and retained for up to 7 years before permanent deletion.

4. Patient Terms

4.1 Medical Information: You agree to provide accurate medical information including medical history, current conditions, emergency contact details, and treatment location. Incomplete or inaccurate information may affect your care.

4.2 Appointments: Appointments are tracked with unique session codes (e.g., PT-YYYYMMDD-XXXX). You agree to attend scheduled appointments or provide reasonable notice for cancellations. Repeated missed sessions may result in account restrictions.

4.3 Home Visits: For home-based treatments, you agree to provide a safe and appropriate environment for therapist visits and accurate address information. You may optionally share your home location coordinates for improved service delivery.

4.4 Session Check-in: Patients are required to approve therapist check-ins at the start of each home visit session. This ensures both attendance verification and your awareness of the session.

4.5 Feedback: After each session, you may provide ratings and feedback regarding the treatment received. This helps us maintain quality of care.

5. Therapist Terms

5.1 Qualifications: Therapists must maintain valid professional licenses and certifications as required by applicable laws. You must provide your professional license number or, if unavailable, an alternative identification.

5.2 Account Approval: Your account requires admin approval for general access, and separate feature-specific approvals for treatment plans, report submission, and attendance marking.

5.3 Professional Conduct: Therapists agree to maintain professional standards of care and conduct in all patient interactions. Maximum 4 appointments may be scheduled per day.

5.4 Session Reports: Therapists are required to submit daily analytical reports for each patient session, including treatment notes, progress assessment, and relevant observations.

5.5 Profile Changes: Any changes to your professional profile (specialization, experience, etc.) must be submitted as a profile change request and approved by an administrator.

6. Location Services and Safety Monitoring

6.1 Purpose: Our location services ensure the safety of both patients and therapists during home visits and verify service delivery.

6.2 Therapist Location Consent: Therapists must grant location permission for home visits. This consent is permanent once granted and is a condition of providing home-based services through our platform. Location data includes real-time GPS coordinates and accuracy metrics.

6.3 Patient Location: Patients may optionally share their home location (latitude/longitude) for therapist navigation and visit verification.

6.4 Proximity Alerts: Our system generates proximity alerts of varying severity (Low, Medium, High, Critical) when therapists are detected near patient locations outside scheduled appointments. These alerts are monitored and resolved by administrators as a safety measure.

6.5 Visit Tracking: Each visit progresses through defined stages (Scheduled → En Route → Arrived → In Session → Completed). Location data may be collected at each stage for safety and verification.

6.6 Manual Location: In case of GPS issues, therapists can submit manual location information including address, arrival/departure times, and notes.

7. Payment Terms

7.1 Service Fees: Fees for physiotherapy services are communicated before treatment begins and are subject to the fee schedule in effect at the time of service.

7.2 Payment Methods: Payments are accepted through both online methods (UPI, bank transfer) and offline methods (cash). We do not store sensitive financial data such as bank account numbers or card details on our platform.

7.3 Payment Records: Payment records and session history are maintained in the system for your reference. You can view your treatment and payment history through your dashboard.

7.4 Missed Sessions: You will not be charged for sessions that were not conducted. If a session is cancelled by the therapist, due to therapist reassignment, or marked as missed, no payment is required.

8. Scheduling and Appointments

8.1 Appointment Types: Our platform supports various appointment types including Initial Assessments, Follow-up Sessions, Treatment Sessions, Consultations, and Emergency Sessions.

8.2 Rescheduling: Appointments may be rescheduled subject to a maximum reschedule limit. Reschedule requests can be initiated by patients, therapists, or administrators and may require approval.

8.3 Treatment Plans: Treatment plans define the number of sessions, duration, and schedule for your physiotherapy program. Changes to treatment plans may require doctor or admin approval.

8.4 Therapist Availability: Therapist availability depends on their schedule, leave status, and existing appointments. The platform checks for appointment conflicts to prevent double-booking.

9. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, the PhysioWay logo, and software, are owned by PhysioWay and its technology partner, Codingbull Technovations Pvt. Ltd. These are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without express written permission.

10. Prohibited Activities

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the Service or other user accounts
  • Interfere with or disrupt the Service or its servers
  • Share account credentials with unauthorized persons
  • Submit false or misleading personal or medical information
  • Harass, abuse, or harm other users including patients, therapists, or staff
  • Circumvent any security measures, safety features, or approval workflows
  • Attempt to bypass the role-based access control system
  • Manipulate or falsify location data or session reports

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. PHYSIOWAY IS A MANAGEMENT PLATFORM — WE ARE NOT DIRECTLY RESPONSIBLE FOR THE QUALITY OF PHYSIOTHERAPY SERVICES PROVIDED BY INDIVIDUAL THERAPISTS USING OUR PLATFORM, THOUGH WE IMPLEMENT OVERSIGHT AND QUALITY MONITORING MECHANISMS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW, PHYSIOWAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. THIS INCLUDES BUT IS NOT LIMITED TO DAMAGES ARISING FROM TREATMENT OUTCOMES, LOCATION DATA INACCURACIES, SCHEDULING CONFLICTS, OR SERVICE INTERRUPTIONS.

13. Termination

13.1 By You: You may request account termination at any time by contacting us. Your data will be soft-deleted in accordance with our Privacy Policy and medical record retention requirements.

13.2 By Us: We may suspend or terminate your account for violation of these Terms, for prolonged inactivity, failure to meet verification requirements, or at our discretion for safety concerns.

13.3 Therapist Termination: Therapist accounts may be deactivated if approval is revoked, contracts expire, or professional conduct standards are not met.

13.4 Effect of Termination: Upon termination, your active appointments will be cancelled or reassigned. Medical and treatment records will be retained as required by law (minimum 7 years).

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, and the Digital Personal Data Protection Act (DPDP Act), 2023. Any disputes arising from these Terms shall be resolved in the courts of Ahmedabad, Gujarat, India.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable under Indian law, the remaining provisions will continue in full force and effect.
